Application
These conditions apply whether a booking has
been made verbally or in writing. The hirer acts on behalf of all
passengers travelling on the vehicles. Where the hirer is a group or
company an individual must be named as responsible person.
The
hirer is responsible for the actions of all passengers and any
additional costs incurred due to the actions of those travelling. We
will only accept instructions from the hirer or the nominated
representative. If you do not wish to be bound by these terms and
conditions you have the right to cancel, which must be in writing and
within seven days.

Quotations
Quotations will be given based on the most
direct/economical route based on the information provided by the hirer.
The route will be at the discretion of the company or its employee
unless particularly specified by the hirer.
Quotations are valid
for 28 days unless specified. All quotations given will be subject to
the company having a suitable vehicle available at the time the
quotation is accepted. All quotations are for coach and driver only,
additional charges will be separately identified and will be the hirer's
responsibility unless otherwise specified.
3 Use of Vehicles
The hirer
cannot assume use of the vehicle between outward and return journeys nor
for it to remain at the destination for the hirer's use unless this has
been agreed in advanced.

Driver Hours
Law regulates the operational hours of the
driver and the hirer is therefore responsible for ensuring the hire
keeps to the times agreed by the company. Neither the hirer nor any
passenger will delay or interrupt a journey in such a way that the
driver is at risk of breaching regulations relating to driving hours and
duty/working time.
If a breech becomes likely to occur the hirer
will be responsible for the additional cost incurred unless it falls
outside the control of the hirer.
5 Time Variation
The company
reserves the right to levy an additional charge for any additional
mileage or time other than that agreed at the time of booking. This
charge will be in accordance with the formula of £30 per hour and 150
pence per mile.
The vehicle will depart at those times agreed by
the hirer and it is the responsibility of the hirer to account for all
passengers at those times. The company is not liable for the driver
following instructions from the hirer.
6 Seating Capacities
At the
time of booking the company will agree and specify the seating capacity
of the vehicle to be supplied. The hirer must not load this vehicle
beyond this capacity.

Animals
No Animals other guide/hearing dogs notified in
advanced may be carried on any vehicle without prior written
agreement.

Payments
Any deposits requested must be paid the date
stated and payment in full must be made before commence of the hire
unless otherwise agreed by the company. We reserve the right to add
interest at the rate of 2% per calendar month after the date by which
payment should have been made.

Cancellations by Hirer
a) If the hirer wishes to cancel a
booking the following charges will apply: 7-1 days to hire 50%, on day
of hire 75%.
b) The cost of any accommodation /meals/entrance tickets
and travel tickets etc. which have already been purchased in advance at
the request of the hirer will be charged to the hirer.
c)
Cancellations due to inclement weather will be charged as
above.
10 Cancellation by the
company
In the event of an emergency, riot, strike,
restraint of labour or a happening of any event over which the company
has no control (including adverse road and weather conditions) the
company may by returning all money paid and without further or other
liability cancel the contract.
11 Vehicle to be provided
The
company reserves the right to provide a larger vehicle than that
specified at no additional charge. The company reserves the right to
substitute another vehicle/s (including vehicles of another operator)
for all or part of hire subject to such substitutes being of equivalent
quality.
12 Breakdown and
delay
The company gives advice on journey times in good
faith. However, as a result of breakdown and traffic congestion or other
events beyond the control of the company, journeys may take longer than
predicted and arrival times cannot be guaranteed.
Alterations
made to pickups and or journey's specified by the hirer will be at their
own risk. In these circumstances the company will not be liable for any
loss or inconvenience suffered by the hirer or passengers as a
result.
13 Agency
arrangements
If the company hires in vehicles or arranges
other facilities such as accommodation, meals, ferries, admission
tickets or any other service provided by another supplier at the request
of the hirer it does so as agent for and on behalf of the hirer. Terms
and conditions imposed by other suppliers shall be binding on the hirer
as if they had directly contracted such services and the hirer shall
indemnify the company against any loss or claim in respect of a breach
of those suppliers' terms and conditions.
14 Package Travel
regulations
If the hirer organises other elements of a
package in addition to the transport, they may be defined as an
organiser or retailer for the purpose of the package travel/package
holiday regulations. In this instance the company cannot accept any
liability that maybe incurred for loss or damage that should have been
the responsibility of the hirer if they were the legally defined
organiser or retailer.
When the company acts as an organiser or
retailer in respect of these regulations it will issue separate
conditions of trade relating to such liabilities and
responsibility.
15 Passengers
property
The hirer accepts that the driver shall be the
judge as to what extent passenger's property is carried. Large/heavy or
bulky items may not be able to be carried so the hirer must notify the
company in advance of such requirements.
The company's liability
for loss or damage, however caused, is limited to £500 per bag or case
and an overall limit of £1000 maximum per passenger. Responsibility
falls on the hirer to ensure that items above this value are insured
separately. Any items of lost property recovered from the vehicles will
be held at the company's premises and will be subject to the current
passenger carrying vehicle regulations for lost property.
16 Conduct of passengers
The
driver is responsible for the safety of the vehicle at all times and may
remove any passenger whose behaviour prejudices safety or is in breach
of the passenger carrying vehicle, conduct of passengers regulations.
The hirer is responsible for any damage or soiling caused to the vehicle
by any passenger during the hire.
Where the hire is to a sporting
event the hirer should be aware of the legal requirements relating to
alcohol on vehicles (contained in the sporting events control of alcohol
act).
17 Complaints
In
the event of a complaint about services provided, the hirer should
endeavour to seek a solution at the time with assistance from the driver
or the company. If this did not provide a remedy, complaints should be
submitted in writing within 21 days of the date of hire.
18 Notices
No poster, bill or
notice is to be displayed on any vehicle without the consent of the
company or driver.

Refreshments and Alcoholic drinks
Other than on a vehicle
fitted expressly for that purpose, food and drink (including alcoholic
beverages) may not be consumed on the vehicle without the consent of the
company.
20 Medical
Conditions
It is the responsibility of the hirer to notify
the company of any passenger who is travelling with a known medical
condition or has a severe illness.
21 Surcharges
Where a booking
has been confirmed and there is in excess of 30 days before the
departure date, the company reserves the right to pass on any increases
in the cost of fuel/road tolls and government taxes (UK or
Foreign).
Upon notification of any surcharge the hirer may cancel
the booking subject to the cancellation charges in paragraph 9. In this
instance the company's liability will be limited to the cost of the
hire.
